Giveaway Terms and Condtitons

Effective: 

These Giveaway Terms and Conditions ("Giveaway Terms") supplement the general Terms and Conditions and Privacy Policy of the Online Store available at www.heyshappy.com. By entering the Giveaway, the Participant agrees to be bound by these Giveaway Terms in addition to the general Terms and Conditions of the Store.

  • GIVEAWAY – Refers to this promotional campaign as described herein.
  • ORGANISER – SHAPPY, operator of the Online Store at www.heyshappy.com, with registered office in Puławy, Poland.
  • PARTICIPANT – A natural person who enters the Giveaway in accordance with these Giveaway Terms.
  • PRIZE – One (1) Shappy Pure Corduroy Play Sofa, as described in Section 4.

1 GENERAL PROVISIONS

The Giveaway is organized by SHAPPY and conducted exclusively through the Online Store. The Giveaway is not a game of chance within the meaning of applicable gambling legislation. No purchase is necessary to enter or win. The Giveaway is void where prohibited or restricted by law.

2 ENTRY PERIOD

The Giveaway begins on at 00:00 UTC and ends on at 23:59 UTC ("Entry Period"). Entries received outside the Entry Period will not be considered.

3 ELIGIBILITY

  • Open to natural persons who are legal residents of the European Union, aged 18 or older, or persons under 18 with verifiable parental or guardian consent.
  • Employees, contractors, and immediate family members of SHAPPY and its affiliates are not eligible to participate.
  • Limit: one (1) entry per person and per email address.

4 THE PRIZE

  • The Prize is one (1) Shappy Pure Corduroy Play Sofa (10 modular pieces), approximate retail value €389.
  • The winner selects their preferred colour from the available options at the time of confirmation (currently: Vanilla, Peppermint, Candy, Pebble, Sky Sugar, Chocolate, Lollipop, Cookie).
  • The Prize includes free delivery to any EU address, delivered within 7 days of winner confirmation.
  • The Prize is non-transferable and cannot be exchanged for cash, store credit, or any alternative item.
  • The warranty terms described in the general Terms and Conditions (Section 6 – Claims and Complaints) apply to the Prize.

5 HOW TO ENTER

  • Visit the Giveaway landing page at heyshappy.com/pages/giveaway during the Entry Period and submit a valid email address using the entry form.
  • Duplicate, automated, or fraudulent entries will be disqualified.
  • No purchase or payment of any kind is required to enter.

6 WINNER SELECTION AND NOTIFICATION

  • One (1) winner will be selected by random draw from all valid entries on .
  • The draw will be conducted by the SHAPPY team.
  • The winner will be notified by email within 24 hours of the draw.
  • The winner must respond within 7 calendar days to confirm their colour selection and shipping address. Failure to respond forfeits the Prize, and an alternate winner may be selected at the Organiser's discretion.

7 PERSONAL DATA PROTECTION

  • By entering, the Participant consents to SHAPPY processing their email address for the purposes of (a) administering the Giveaway and (b) sending marketing communications (newsletter). The Participant may unsubscribe at any time by emailing contact@heyshappy.com or clicking the unsubscribe link in any email.
  • Personal data is stored securely and retained for a maximum of 12 months from the date of entry. The Participant may request deletion at any time.
  • Data will not be shared with third parties, except our email service provider (Klaviyo), solely for delivering communications.
  • For full details, see the Privacy and Cookies Policy available on the Store's website.
  • The Organiser's data protection practices comply with Regulation (EU) 2016/679 (GDPR).

8 DISQUALIFICATION

The Organiser reserves the right to disqualify any Participant who submits fraudulent, automated, or duplicate entries, violates these Giveaway Terms, or engages in conduct that the Organiser deems inappropriate or harmful to the Giveaway.

9 LIMITATION OF LIABILITY

The Organiser is not responsible for: (a) entries lost, delayed, misdirected, or incomplete due to technical issues or circumstances beyond the Organiser's control; (b) delays in Prize delivery caused by shipping carriers or force majeure; (c) any injury or damage arising from the acceptance or use of the Prize. To the fullest extent permitted by applicable law, the Organiser's total liability in connection with the Giveaway shall not exceed the retail value of the Prize.

10 FINAL PROVISIONS

  • The Organiser reserves the right to cancel, modify, or suspend the Giveaway if circumstances beyond its control make it necessary. Any changes will be communicated on the Giveaway landing page.
  • These Giveaway Terms are governed by Polish law. Any disputes shall be resolved by the court with jurisdiction over the Organiser's registered office in Puławy, Poland, except in cases involving Consumers, where disputes will be settled in accordance with civil procedure rules. These Giveaway Terms do not limit the Consumer's rights to protection under the mandatory provisions of law in their country of residence.
  • By entering, Participants agree to be bound by these Giveaway Terms and the decisions of the Organiser, which are final.
