Play Sofa + Arches prize draw: terms and conditions

Play Sofa + Arches prize draw: terms and conditions

1. Promoter

  1. The promoter of the prize draw is Shappy Sp. z o.o., Marsz. J. Piłsudskiego 57, 24-100 Puławy, Poland (register court: Lublin, KRS 0000963087, VAT number PL7162835589), owner of the Shappy brand and the online shop heyshappy.com (the “promoter”).
  2. Contact for the prize draw: contact@heyshappy.com.
  3. The prize draw is in no way sponsored, endorsed or administered by, or associated with, Meta Platforms Ireland Ltd., Facebook or Instagram. Entrants release Meta from any liability in connection with the prize draw. Questions and complaints should be sent to the promoter, not to Meta.
  4. The promoter follows the rules on prize promotions in the participating countries. For entrants who live in the Netherlands, the promoter follows the Dutch code of conduct for promotional games of chance (Gedragscode Promotionele Kansspelen 2014), and for entrants who live in France, Article L. 121-36 of the French Consumer Code (Code de la consommation).

2. Entry period and scope

  1. Entries can be made from 2 November 2026 until 23:59 on 19 November 2026. All times are Central European Time (CET), the time in Germany. This is 22:59 local time in the United Kingdom and Ireland, and 00:59 local time on 20 November 2026 in Bulgaria, Estonia, Finland, Greece, Latvia, Lithuania and Romania.
  2. The winner will be drawn on 20 November 2026.
  3. There is one single prize draw for all the participating countries in clause 3.1, with one draw and one prize. These terms are available in German, Dutch, French, English and Spanish. All language versions have the same content and the same validity.
  4. This prize draw is separate from the “Shappy test family”, “Shappy Testfamilie” and “Shappy testgezin” prize draws and from any other prize draw run by the promoter. Their own terms continue to apply to them unchanged. Entering this prize draw makes no difference to entries in any other prize draw, and the other way round.

3. Who can enter

  1. The prize draw is open to individuals who, at the time of entry, are aged 18 or over, enter as consumers in their own name and live in one of the following countries (the “participating countries”): Austria, Belgium, Bulgaria, the Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Ireland, Latvia, Lithuania, Luxembourg, the Netherlands, Romania, Slovakia, Slovenia, Spain, Sweden, Switzerland and the United Kingdom (England, Scotland, Wales and Northern Ireland). Areas of these countries that the heyshappy.com online shop does not deliver to are not included, in particular the French overseas territories, the Canary Islands, Ceuta and Melilla, the Faroe Islands, Greenland, the Channel Islands and the Isle of Man.
  2. Under-18s cannot enter.
  3. The following people cannot enter: employees of the promoter and anyone working for it under any type of contract; anyone involved in preparing or running the prize draw, including agencies and service providers; and close family members of these people (spouse or partner, children, parents, brothers and sisters) and anyone living in the same household as them.

4. How to enter

  1. To enter, entrants must complete the form in a pop-up window on the heyshappy.com online shop during the entry period in clause 2.1. There is no other way to enter. In the pop-up window, entrants only give their email address. By clicking the entry button, they accept these terms and confirm their age and that they live in a participating country. A notice below the button says so.
  2. Entry is free and no purchase is necessary.
  3. Only one entry per person is allowed. Further entries from the same person, including entries with a different email address or through the pop-up window of another language or country version of the online shop, do not increase the chance of winning and are not included in the draw.
  4. Entry is only possible together with signing up to the promoter's email newsletter. This applies to the pop-up window in all language and country versions of the online shop. Clicking the entry button also gives consent to the newsletter.
  5. The newsletter is sent by email, with news about new products, promotions and play inspiration. Entrants can withdraw their consent to the newsletter at any time, most easily via the unsubscribe link in every email. Entrants who unsubscribe after entering stay in the prize draw, with the same chance of winning.
  6. The promoter may exclude entries that breach these terms, in particular entries with false details, automated entries and entries made by the same person with several email addresses.

5. Prize

  1. There is one prize: a set made up of a Shappy Play Sofa Pure Corduroy (160 × 80 × 56 cm, an 8-piece set of 2 seat modules, 2 triangles, 2 armrests and 2 round cushions) and the Shappy Arches Original Corduroy, each in a colour chosen by the winner from the colours available for that product on heyshappy.com on the day the colour is chosen. In other language versions of the online shop, the products are called, for example, Spielsofa, Speelbank, Canapé de Jeu or Sofá de Juego, and Bögen, Bogen or Arcos.
  2. Value of the prize: €588.00 including VAT (Play Sofa €399.00, Arches €189.00; selling prices in euros on heyshappy.com on 2 November 2026). For Switzerland and the United Kingdom, the value is given in euros. On the same day, the two products together cost CHF 618.00 in the Swiss version of the online shop and £598.00 in the UK version.
  3. The prize is awarded as goods. The promoter delivers the prize at its own cost to an address in the participating country where the winner lives. Deliveries to Switzerland and the United Kingdom are delivered duty paid (DDP): the promoter also pays any customs duty, import VAT and other fees due on delivery, so the winner pays nothing on delivery.
  4. There is no cash alternative to the prize, and it cannot be exchanged for other products. The prize cannot be transferred to anyone else.
  5. The prize comes with the same 3-year warranty as products bought on heyshappy.com.
  6. Any Dutch gaming tax (kansspelbelasting) is paid by the promoter.

6. The draw

  1. On 20 November 2026, the draw is carried out by a committee of two people appointed by the promoter.
  2. All valid entries from all participating countries take part in the draw, whichever language or country version of the online shop the pop-up window was completed in. Every entry has the same chance of winning.
  3. The committee selects one winner and two reserve winners, in the order drawn, using random.org, a computer process that produces verifiably random results.
  4. The committee keeps a written record of the draw, including the random.org result. The promoter keeps the record until the end of the complaints period or, if there is a dispute, until it is resolved.

7. Notifying the winner and delivering the prize

  1. The promoter will email the winner on the day of the draw, and no later than 3 working days after it, at the email address given in the pop-up window.
  2. To claim the prize, the winner must reply within 7 days of the email being sent, giving their first name and surname, a delivery address in the participating country where they live, a phone number for the courier and the chosen colours of the Play Sofa and the Arches.
  3. If the winner does not reply in time, does not meet the conditions in clause 3 or turns down the prize, the prize passes to the first reserve winner and then to the second, on the same terms.
  4. The promoter will dispatch the prize by courier within 14 days of receiving these details, so that the winner receives it by 31 January 2027 at the latest, also if the prize passes to a reserve winner. The Play Sofa is delivered vacuum-packed.
  5. The promoter is not responsible if it cannot contact the winner because the email address given in the pop-up window is wrong.
  6. The promoter may ask the winner to confirm their age and country of residence in a way that does not require a copy of an identity document.
  7. The promoter will only publish the winner's first name, the first letter of their surname and their country with the winner's consent. To show that the prize has been awarded, the promoter will make the winner's surname and region (county in the United Kingdom and Ireland) available on request, as the UK advertising code for promotions (CAP Code) requires. The winner can object to this by emailing contact@heyshappy.com. In that case the promoter will only say that the prize has been awarded, but may still have to give the winner's details to an advertising regulator if it asks for them.

8. Personal data

  1. The promoter is the controller of entrants' personal data. Contact for data protection questions: contact@heyshappy.com. Personal data is processed under the GDPR, for entrants in the United Kingdom under the UK GDPR and for entrants in Switzerland under the Swiss Federal Act on Data Protection (FADP).
  2. The promoter processes personal data for these purposes: to run the prize draw, confirm entries by email, notify the winner and deliver the prize, because this is necessary for taking part in the prize draw under these terms (Article 6(1)(b) of the GDPR); to send the newsletter (clauses 4.4 and 4.5), on the basis of entrants' consent (Article 6(1)(a)); to meet tax and accounting obligations connected with the prize (legal obligation; Article 6(1)(c)); and to handle complaints and defend legal claims (legitimate interests; Article 6(1)(f)).
  3. Personal data processed: the email address of all entrants, the time of entry (which is also when they consented to the newsletter), the country version of the online shop and, if they unsubscribe, when they did so; and also the first name and surname, delivery address and phone number of the winner.
  4. Recipients of the data: Klaviyo, Inc. (provider of the form on the online shop and sending emails), UPS (delivering the prize), the promoter's external accountants and IT service providers, each under a data processing agreement. Data may be transferred to the USA on the basis of the EU-US Data Privacy Framework, its UK Extension and the Swiss-US Data Privacy Framework, or of standard contractual clauses.
  5. Retention: the promoter keeps entrants' data for sending the newsletter until they unsubscribe. If an entrant unsubscribes before the complaints procedure in clause 9 has ended, the promoter only uses their data for the prize draw and deletes it within 30 days of the end of the complaints procedure, unless they won. It keeps the data of the winner and the reserve winners for as long as tax and accounting rules require.
  6. Every entrant has the right of access, rectification, erasure, restriction of processing and data portability, the right to object and the right to withdraw consent at any time. Withdrawing consent does not affect the lawfulness of processing before the withdrawal.
  7. Every entrant can complain to a data protection supervisory authority, in particular the President of the Personal Data Protection Office (Prezes Urzędu Ochrony Danych Osobowych, UODO) in Poland, or the authority in their country of residence, for example the Information Commissioner's Office (ICO) in the United Kingdom or the Data Protection Commission in Ireland.
  8. Giving an email address and signing up to the newsletter are voluntary, but without them it is not possible to enter the prize draw (clause 4.4). Consent to the newsletter can be withdrawn at any time without affecting the entry (clause 4.5).

9. Complaints

  1. Complaints about the prize draw can be sent within 14 days of the draw by email to contact@heyshappy.com or by post to the promoter's address.
  2. A complaint should include the email address used in the pop-up window and a description of the issue.
  3. The promoter will deal with the complaint within 14 days of receiving it and reply by email.
  4. The complaints procedure does not limit the right to bring a claim in court.

10. Final provisions

  1. These terms are available free of charge throughout the prize draw at https://heyshappy.com/en-gb/pages/prize-draw-play-sofa-arches.
  2. The promoter may only change these terms for an important reason and only in a way that does not disadvantage entrants. It will only change the closing date if circumstances beyond its control make this unavoidable. Changes apply from their publication at the address in clause 10.1.
  3. These terms are governed by Polish law. This does not affect the mandatory consumer protection rules of the country where the entrant normally lives.
  4. Any matters not covered by these terms are governed by the applicable law.
